Object of business:
In its capacity as balance group coordinator (BGC), AGCS Gas Clearing and Settlement AG acts as the clearing and settlement agent of the Austrian distribution area east. Its responsibilities comprise the administration of balance groups in organisational, and clearing and settlement terms, as well as the calculation and allocation of imbalancing energy. The BGC is responsible, in conjunction with the market participants, system operators and distribution area manager, for maintaining an orderly, impartial and data secure balancing market.

The Electricity Act 2010 (ElWOG 2010) and Gas Economy Act (GWG 2011) assigned a new task to the balance group coordinator who must install and operator a platform available to the market participants, including distribution system operators, suppliers, and balancing group representative(s) (BGR). The processes for supplier switching or enabling and disabling metering points which are executed on the platform are specified by the regulatory authority Energie-Control Austria.

The amendment of the Austrian Renewable Power Act (Ökostromgesetz 2012) mandates the Austrian balancing group coordinator according to the Gas Economy Act (Gaswirtschaftsgesetz as amended) to issue monthly certificates with unique identification for energy volumes from biogas (biomethane) injected into the Austrian gas grid. The original legal text of § 21 (1) 2012 translates as follows: “The balancing group coordinator pursuant to the Gas Economy Law [GWG, Gaswirtschaftsgesetz 2011] has to issue proofs of injected biogas [biomethane] including a unique identification for and on costs of the Austrian Green Power Settlement Agency [OeMAG Abwicklungsstelle für Ökostrom AG].”

The Clearing Agent shall process all personal data disclosed in the course of the execution of the contract - as far as necessary - for the fulfilment of its legal and contractual duties or duties granted by regulation or official order, as well as to transfer these data - in whole or in part - for the fulfilment of its duties to its assistants or processors as defined by the General Data Protection Regulation (EU Data Protection Regulation (EU) 2016/679 (GDPR), to smart technologies Management- Beratungs- und Beteiligungsgesellschaft m.b.H. and to Cismo Clearing Integrated Services and Market Operations GmbH for further processing.
The parties authorised to access the biomethane certificate system (Biomethan Register Austria) acknowledge that the personal data of the authorised party - name, company telephone number, company e-mail address, company address, as well as the logged procedural steps for the fulfilment of the legal obligation pursuant to § 21 ÖSG - transmitted in the course of the preparation of the contract will be stored and processed, in particular for the purpose of authentication. The listed personal data as well as the associated log data of the accesses are furthermore processed and stored in the legitimate interest of the Clearing Agent to prevent unauthorised use of the biomethane certificate system. A data transfer to the competent authorities must take place within the framework of the legal obligations.
The web pages of AGCS used the service “Google Analytics” with anonymised IP addresses as well as “cookies”. The relevant information on this can be found in the data protection information below (on the AGCS website www.agcs.at).
Storage period/deletion period: All data is generally stored for the duration of the contract and beyond, as long as this is necessary for the assertion, exercise or defence of legal claims (maximum 30 years).
